Ancestral Property Not Immune from PMLA Attachment: Delhi HC Rules
•The Delhi High Court ruled that ancestral property is not exempt from attachment under the Prevention of Money Laundering Act (PMLA).
•A bench of Justices Navin Chawla and Ravinder Dudeja stated that PMLA has no exception for ancestral or inherited properties in money laundering proceedings.
•The court dismissed an appeal by a man whose Sainik Vihar property, jointly owned with his father, was attached by the Enforcement Directorate.
•The appellant argued the property was not purchased with illicit funds, but the court found this stand misconceived and contrary to PMLA.
•The court affirmed that the property represented a value equivalent to 'proceeds of crime' and its ancestral nature does not grant immunity.
