Bombay HC: WhatsApp Chats Alone Can't Prove Cruelty for Divorce

Bombay High Court ruled WhatsApp chats alone are insufficient to prove cruelty for divorce without giving the spouse a chance to rebut.
•
The HC quashed a Nashik family court order that granted divorce to a man based on his wife's WhatsApp messages.
•
The family court had relied on chats where the wife allegedly demanded shifting to Pune and made derogatory comments against in-laws.
•
The High Court noted the family court failed to allow the wife to rebut the evidence, stating chats must be "proved by leading evidence."
•
The matter is remanded to the family court, giving the wife an opportunity to be heard and submit evidence; mediation is also suggested.
