Uttarakhand HC: V-C Lacks Authority to Charge-Sheet Professor
•The Uttarakhand High Court ruled that the Vice-Chancellor of Govind Ballabh Pant University of Agriculture and Technology cannot issue a charge sheet against a professor.
•A division bench of Chief Justice Manoj Kumar Gupta and Justice Subhash Upadhyay directed the university to withdraw the charge sheet against Professor Shivendra Kashyap.
•Professor Kashyap, of Agricultural Communication and Coordinator of DST-TEC, had challenged a charge sheet dated February 5, 2026, and subsequent disciplinary proceedings.
•Advocate Vipul Sharma argued that under Uttarakhand Government Servants (Discipline and Appeal) Rules, 2003, only the appointing authority (disciplinary authority) can issue a charge sheet.
•The court clarified that if a new charge sheet is issued, Professor Kashyap is free to challenge it legally.
